The National Energy Board (NEB) is the federal agency that administers oil, gas or electricity projects traversing provincial boundaries. As such, it is responsible for organizing public consultations on pipeline construction or pipeline flow inversion. However, the NEB does not evaluate any upstream or downstream consequences of the projects that have been submitted, such as tar sands GHG emissions or air quality around rafineries. In addition, people or organisations who wish to participate in the NEB consultation on a project will find the procedures cumbersome with short deadlines.
Many municipalities, organizations and RCMs have already passed a resolution to ask the Quebec government to conduct an independent environmental assessment. Municipalities in the United States go further and prohibit the passage of oil from tar sands in their territory or propose investment in renewable energy instead.
